RESUMO Este trabalho visa à análise dos Planos Municipais de Gestão Integrada de Resíduos Sólidos (PMGIRS), com o conteúdo previsto na Lei nº 12.305/2010, quanto à implantação da coleta seletiva. A Política Nacional de Resíduos Sólidos (PNRS) hierarquizou a gestão e o gerenciamento de resíduos sólidos: não geração, redução, reutilização, reciclagem, tratamento e disposição final ambientalmente adequada dos rejeitos, além da responsabilidade compartilhada dos setores privado e público. Nesse contexto, a coleta seletiva se mostra instrumento-chave para essa hierarquia, sendo os PMGIRS importantes na definição de ações necessárias à concretização das metas desejadas. Para tanto, analisamos 17 planos de municípios com população acima de 200 mil habitantes. A análise concluiu pela não aderência da maior parte da amostra estudada, nos aspectos de coleta seletiva e reciclagem, por não atender aos requisitos mínimos da PNRS. Porém, os planos refletem pré-disposição para mudança e aumento da escala dada ao serviço prestado.

ABSTRACT This work aims at the analysis of Municipal Integrated Solid Waste Management Plans (PMGIRS), as the minimum content required under by the law number 12.305/2010, regarding the implementation of selective waste collection. The Brazilian National Solid Waste Policy (PNRS) tiered solid waste management: non-generation, reduction, reuse, recycling, treatment and environmentally correct final disposal of wastes, as well as the shared responsibility between public and private sectors. In this context, the selective collection proves to be a key tool for this hierarchy, being the PMGIRS important in the definition of actions required to achieve the desired goals. To this end, 17 elaborated plans of municipalities with population over 200 thousand inhabitants were analyzed. The analysis concludes by non-compliance of the majority of the sample studied, in aspects of selective collection and recycling, for failing to meet the minimum requirements of the PNRS. However, the plans reflect a predisposition for change and increase the scale given to the service provided.

The present article discusses the challenges that must be met to achieve universal access to water and sewer services in Brazil. First, the principles concerning the topic in Brazilian law are presented, as well as theoretical aspects including concepts relating to universalization and the standards of service employed. The main challenges for the universalization of water and sewer services in Brazil include the definition and establishment of public policies and designation of responsibility for the provision and regulation of these services. Despite the significant amount of resources available for universalization in Brazil, institutional issues in this sector hinder the broadening of the coverage, inhibiting the investments in sanitation infrastructure.

Objetiva-se, aqui, apresentar os aspectos conceituais da regulação da prestação dos serviços de água e esgoto no Brasil e analisar de forma comparativa essa regulação com a de outros setores da infraestrutura. O estudo parte do pressuposto da regulação como intervenção do Estado voltada para a eficiência e a equidade, e apresenta os fundamentos teóricos que justificam essa regulação de forma contextualizada às características do setor de água e esgoto. Mediante análise comparativa com outros setores de infraestrutura de redes, concluí-se que, em função das características físicas, econômicas e institucionais do setor de água e esgoto, será bastante complexo o estabelecimento efetivo dessa atividade conforme os princípios da lei nº 11.445/2007.

The objective of this paper is to present the conceptual aspects of the regulation of water and sewage services in Brazil and to perform a comparative analysis of this regulation to the other sectors of the infrastructure. This study is based on the assumption of regulation as an intervention of the State turned to the efficiency and fairness, and presents the theoretical foundations to justify this regulation in the context of the characteristics of water and sewage sector. By comparison with other sectors of infrastructure networks, it has been concluded that depending on the physical, economic and institutional characteristics of water and sewage sector, this activity is quite complex to be effectively established according to the principles of law 11.445/2007.

Este artigo analisa os marcos regulatórios estaduais para o setor de saneamento básico. A pesquisa documental identificou a presença de leis estaduais em apenas cinco estados (São Paulo, Minas Gerais, Rio Grande do Sul, Rio Grande do Norte e Goiás). Os marcos legais estaduais são descritos quanto a um conjunto de atributos ou funções selecionadas: universalização, instrumentos financeiros, regulação e controle social. A principal conclusão é que o desenvolvimento dessas políticas, assim como sua regulamentação, encontra-se em estágio incipiente e poderá receber impulso com aprovação de nova lei federal de dezembro de 2006.

This paper analyzes state regulatory frameworks for the water and sanitation sector in Brazil. The documental research identified that only five states have their own policies (São Paulo, Minas Gerais, Rio Grande do Sul, Rio Grande do Norte, and Goiás). The frameworks are described according to a selected set of attributes, namely: universal access to water and sanitation, financial instruments, regulation and social control. The main conclusion is that the policies under study are in an early stage of development and may receive a boost from the approval of new federal legislation in December 2006.

Objetiva-se neste trabalho discutir a viabilidade da regulação subnacional do saneamento básico no País de acordo com o estabelecido na Lei no 11.445/2007. Foi analisada a viabilidade da regulação municipal em 2.523 municípios, com base na amostra do Sistema Nacional de Informações em Saneamento (SNIS) referente a 2005, mediante a aplicação de taxas de regulação de 1 a 3% do faturamento das concessionárias. Concluiu-se que a regulação local não apresenta viabilidade em 97% dos municípios pesquisados.

The objective of this paper is to discuss the feasibility and the alternatives for the sub-national regulation of the basic sanitation in Brazil, as established one in the Law 11.445/2007. We analyze a sample of 2.523 municipalities from the data set of the National System for Information on Water Supply and Sewerage Services (SNIS) of 2005, assuming regulatory fees ranging between 1% and 3% of the concessionaire’s revenues. We concluded that local regulation was impracticable for 97% of the municipalities in the sample.

O presente estudo apresenta uma análise comparativa de aspectos específicos dos instrumentos contratuais de concessão dos serviços de abastecimento de água e coleta e tratamento de esgoto em quatro municípios brasileiros, firmados em anos recentes, no contexto da superação do modelo legal instituído pelo Planasa a partir da década de 1970. Os contratos foram avaliados quanto ao pagamento de outorga, tarifas, metas de cobertura e investimentos, regulação, fiscalização e controle social, e direitos dos usuários. A análise realizada evidenciou a falta de uniformidade no tratamento de questões relevantes nas concessões, sugerindo que tal fato decorra da indefinição de um novo marco regulatório aplicável ao setor de saneamento.

This paper presents a comparative analysis of specific aspects of concession agreements for water supply and sewage collection and treatment services in four Brazilian counties, undertaken in recent years, within the context of overcoming the legal model instituted by Planasa as of the 1970s. The contracts were analyzed about permission payment, tariffs, coverage and investment goals, regulation, supervision and social control, and the right of consumers. The analysis performed showed the lack of uniformity in regard to relevant concession issues, suggesting that this may result from failure to define a new regulatory benchmark applicable to the sanitation sector.
